A former accountant from Dallas is tonight if a federal court doesn't intervene.
John Battaglia went to death row for killing his nine and six-year old daughters in 2001 as their mother listened helplessly on the phone.
The girls were at Battaglia's apartment during a scheduled visit. He and his wife were separated.
Appeals from his lawyers to the 5th U.S. Circuit Court in New Orleans and the U.S. Supreme Court contend Battaglia's delusional and mentally incompetent for execution. If the courts deny the appeal, Battaglia will be the third Texan executed this year.
