What would property tax relief from the Legislature mean for Texas renters?

With a historic state budget surplus of $32 billion, lawmakers have earmarked $15 billion to ease property tax bills.

In a two-bedroom South Austin apartment, Maddie Hastings goes through the familiar routine of giving a tour.

鈥淟ast year, I think I took about 350 leads and leased about 110 of those or so,鈥 she told the Texas Standard.

As an apartment locator coming up on 3 1/2 years in the business, she knows exactly what people ask about. She makes note of the apartment鈥檚 large balcony, the in-unit washer and dryer, and the walk-in closet. Pacing through the kitchen, she points out stainless steel appliances, formica countertops and white cabinets with new hardware fixtures.

As a native Austinite who now spends her days comparing square footage, amenities and locations, Hastings describes a familiar routine to interactions with her clients: 鈥淯sually what happens is they鈥檒l give me a budget, I鈥檒l send them places within their budget, and then they realize what they want is going to cost more.鈥

In Texas, the is $1,146 a month. For this apartment, a partially renovated 2-bed, 2-bath located in one of the country鈥檚 hottest real estate markets, that figure is $1,565.

鈥淪o, location, then size, then newness and niceness are typically the three things that for most people, they have to choose two out of three,鈥 Hastings said.

Calculating cost of rent

When it comes to figuring out what factors into the cost of an apartment, there are a handful of well-known indicators among renters: size, location, age of the complex. For rental property owners, the calculation is a little different.

Things like insurance, repairs, mortgage payments and payroll expenses play a large role in operating rental properties 鈥 and according to , the biggest factor of all is property taxes, accounting for as much as 40% of all operating expenses.

禄 TELL US: 

David Mintz, vice president of government affairs for the Texas Apartment Association, helps represent the interests of 10,000 rental property owners. His rough guideline for figuring out how much of a typical rent payment is earmarked for taxes is that it can be twenty cents on the dollar or more going toward the property tax bill.

All this means that when property taxes rise, landlords will often raise rents in response.

Of course, property owners always have the option of selling their property should taxes (or any other expense) become too burdensome, but as Mintz points out, 鈥渢he difficulty is when somebody else comes in to buy that property, if they鈥檙e going to maintain it as a rental property, they still have the same pressures of those operating costs that get translated to rent.鈥

A sign of relief

The Texas Legislature is back in session, and the biggest item on lawmakers鈥 agenda at the moment is figuring out what to do with a 鈥 and the issue with broadest support is property tax relief. have set aside $15 billion to ease property tax bills.

鈥淧roperty taxes are one of the top issues for our association this session, and we鈥檙e really pleased to see that the Legislature is looking at using a substantial part of the surplus to help provide some property tax relief,鈥 Mintz said.

With , robust property tax relief is an understandably popular proposal. For renters, though, the benefit is not as straightforward.

Emily Eby French, a voting rights attorney who rents in Austin, said that allocating so much money for property tax relief is a missed opportunity: 鈥淭here are just so many issues in Texas where money would fix the problem,鈥 she said.

Eby French extends a lot of sympathy to any Texan struggling to cover the property tax bill, whether it be low-income homeowners, those on fixed incomes or even smaller-scale landlords 鈥 she鈥檚 even got a close personal friend who rents out property on the side. 鈥淲e do bust his chops a lot in the group chat,鈥 she joked.

The state鈥檚 surplus, she insists, should be more narrowly focused on things like raising teacher pay, increasing funding in Texas鈥 foster care system, and expanding social programs.

鈥淚 do understand that if you need a passive income and you already were able to buy a place, that can be something I sympathize with 鈥 and still would rather have teacher pay increases than cut my landlord friend a check, and I think he would understand,鈥 she said.

A potential upside for renters

If renters are going to see the benefits of property tax relief, it鈥檒l have to be through their property owners. Mintz points out that generous property tax relief could help landlords hold off on further rent increases.

鈥淭hat鈥檚 probably a good way to think about it,鈥 he said. 鈥淚f there is property tax relief, more likely than not, that relief is going to help mitigate the pressure to increase rents more.鈥
